TERMS & CONDITIONS

  1. SUBJECT OF THE SUPPLY - The supply only includes that indicated in the order confirmation. Features and information given in catalogues or illustrations are always approximate and it is therefore the seller’s right to make any variations considered necessary without advance warning.
  2. ORDERS - These are always binding for the purchaser: the seller shall only be committed after written confirmation. It is, however, understood that each order is placed with the purchaser’s full acceptance of all general conditions established by the seller. Only articles of current production shall be contemplated in the order. Every order shall be made in writing although this can be preceded by a telephone call or email in the event of urgent need.
  3. DELIVERY TERM - This runs from the date of the order confirmation and shall be considered as approximate; it shall not, in any case, be considered an essential condition and may be extended by the seller in the event of unforeseen circumstances.
  4. DISPATCH - Dispatch is understood to have been made the moment in which the goods are placed at the purchaser’s disposal on deliver to the carrier. Partial dispatches are also permitted without this being considered by the customer as cause of delay.
  5. TRANSPORT - The seller shall dispatch the goods via the means considered most opportune without this entitling the purchaser to make claims.
  6. INSURANCE - Only if requested and always at the purchaser’s charge.
  7. PACKING - Excepting different agreements accepted by the seller packing shall always be in cartons, unless orders are fewer than 5 items: all responsibilities of the seller shall cease once delivery has been made to the purchaser or carrier without claims or reserves.
  8. CLAIMS Claims pertaining to missing goods or breakages shall only be made to Tile Boutique. Any other claim concerning the nature or features of the material shall be immediately forwarded to the seller by means of registered letter no later than 10 days following receipt of the goods themselves. Once these terms have elapsed the goods shall be understood to have been examined and accepted as they are.
  9. GUARANTEE - The seller guarantees the quality of the supplied materials according to the grades requested by the purchaser: the seller undertakes to replace in equal quantities those materials which, according to his final judgment, present defects as to be considered not in compliance with the order, without, moreover, being obliged to reimbursement of direct or indirect damages for any reason whatsoever. The guarantee cannot be transferred and shall only be valid for the purchaser to whom the sales invoice is made out.
  10. UNFULFILLMENTS AND INSOLVENCIES - In the case of total or partial unfulfilled or delayed payment the seller shall have the right to completely or partly withdraw from a contract in progress and to demand all his rights.
  11. PRICES - These are always understood to refer to the price list in force at the moment of the seller’s confirmation. They always pertain to goods delivered ex works and do not, therefore, include other charges such as VAT, stamps or taxes of any nature which shall be on the purchaser.
  12. PAYMENTS Payments shall always be fulfilled as indicated on the order confirmation: in any case, the place of payment shall always be the registered offices of Tile Boutique Ltd even if made through authorized personnel direct remittance, authorized drafts or bills. Failure to comply with the terms of payment entitles the seller to: - calculate the arrears interests at the current commercial rate, plus expenses; - suspend fulfilment of orders in progress; - in the event of protests, to correct the total due on sight.
  13. RESERVE OF PROPERTY - All goods shall remain the property of Tile Boutique Ltd until payment is made in full.

DELIVERY POLICY

It is understood that each order is placed with the purchaser’s full acceptance of all general conditions established by the seller.

  1. Delivery Term - This runs from the date of the order confirmation and shall be considered as approximate; it shall not, in any case, be considered an essential condition and may be extended by the seller in the event of unforeseen circumstances.

Delivery Time - Approximate delivery time is 2-3 working days from receipt of order within the U.K. For items ordered on Friday before 2PM, “Next Day” delivery refers to the next working day, Monday. Saturday delivery can only be arranged if contacted and pre-arranged. We are unable to arrange courier service to deliver items on Sundays or Bank Holidays. Orders placed on Friday after 2PM, Saturday or Sunday for “next day delivery” will be packed and shipped on the following working day i.e. Monday, for arrival on Tuesday.
  4. Transport - The seller shall dispatch the goods via the means considered most opportune without this entitling the purchaser to make claims.
  5. Insurance - Only if requested and always at the purchaser’s charge.
  6. Packing - Excepting different agreements accepted by the seller packing shall always be in cartons, unless orders are fewer than 5 items: all responsibilities of the seller shall cease once delivery has been made to the purchaser or carrier without claims or reserves.
  7. Cost - All orders over £250.00 within the U.K (except regions of Scotland / Northern Ireland) are free from delivery charge; any orders less than this value will be charged £15.00 delivery. Additional delivery charges are levied for regions of Scotland / Northern Ireland, please telephone for quotation. International deliveries are also available, please telephone for quotation.
  8. Delivery Details - Please ensure you provide a correct postcode and address; our ordering system automatically creates shipping labels based on the information you provide. If the information you provide us is incorrect and you do not inform us upon receipt of your Despatch Notice / Acknowledgement, we will not be held responsible for any delay or failure to comply with our obligations as the delay or failure arises from a cause which is beyond our reasonable control. This condition does not affect your statutory rights. If there is likely to be a problem with your delivery, then we will attempt to contact you. Please ensure that the contact details you give are accurate - we will attempt to e-mail you or telephone you. We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
  9. Re-delivery Service - The carrier will provide a redelivery service at no additional charge. A notice of attempted delivery will be left at the recipient’s address after each attempted delivery, indicating date and time of the presentation. Any Shipment which cannot be delivered after three (3) attempted deliveries will be returned to the nearest carrier facility and an attempt made to notify the Recipient. In the case of deliveries to a private address (“Residential Deliveries”), only one re-attempt will be made after the initial attempted delivery. If the Shipment has not been delivered after three (3) attempted deliveries (two (2) in case of a “Residential Delivery”) or after being held for five (5) business days from the date the shipment is received and has cleared customs in a destination station, it will be considered undeliverable.
  10. Undeliverable Shipments - A Shipment is considered as undeliverable if (i) the Recipient’s address is incomplete, illegible, incorrect or cannot be located, (ii) delivery is impossible because of the unavailability or refusal of an appropriate person to accept delivery or sign for delivery of the Shipment on the initial delivery attempt or reattempts, (iii) the Shipment is unable to clear Customs, (iv) the Shipment would likely cause damage or delay to other Shipments or goods, or injury to persons, (v) the Shipment contains prohibited items, (vi) the Recipient is unable or refuses to pay for a Bill Recipient Shipment, or (vii) the Shipment’s contents or packaging are damaged to the extent that re-wrapping is not possible.
  11. Charges - Return Charges will be assessed to the recipient together with the original Charges, unless the Shipment was undeliverable due to the fault of the carrier or Tile Boutique. Also included will be any other Charges incurred by the carrier or Tile Boutique including but not limited to duties, taxes and storage fees, if applicable.

CANCELLATIONS, RETURNS & REFUND POLICY

It is understood that each order is placed with the purchaser’s full acceptance of all general conditions established by the seller.

  1. 14 days to Return - If you are unhappy with your order, you may return it to Tile Boutique within 14 days of the date of delivery. The item must be in its original condition, with all packaging materials, leaflets, brochures, information sheets and accessories intact. We reserve the right to refuse returns or to charge you for our reasonable cost if the product is received otherwise than in accordance with these requirements. This does not affect Your Statutory Rights.
  2. Defective Items - If the item is defective, please contact Tile Boutique where we will discuss the defect and, if necessary, arrange to assess the item in person. Tile Boutique will work with you to resolve any issues that may arise. If it cannot be rectified, we will at our discretion arrange to replace the item.
  3. By Law - By law, customers in the European Union also have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. This applies to all of our products.
  4. Returning Items - We regret that we cannot accept cancellations of contracts for the purchase of products where the item has been unsealed or used. To cancel your purchase within the seven-working-day cooling-off period, please notify Tile Boutique by phone, or email, stating the reason for the return. Please package the relevant item(s) securely and return it to us within 30 days following the date that the item was delivered to you. For your protection, we recommend that you use a recorded delivery service if the value of the return is more than £50.00. Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. If we do not receive the item back from you with the delivery slip, we may arrange for collection of the item from your residence at your cost.
  5. Refunds - As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item together with the item’s normal postage charge within 7 days. If a credit or debit card has been used, the money will be refunded to this card and may take up to 30 days to appear on the card statement - we cannot refund any priority, express or courier component of the postage charge.   6. Charges - Return Charges will be assessed to the recipient together with the original Charges, unless the Shipment was undeliverable due to the fault of the carrier or Tile Boutique. Also included will be any other Charges incurred by the carrier or Tile boutique including but not limited to duties, taxes and storage fees, if applicable.
  7. Claims for Damage - All claims must be made within 24 hours from receipt of delivery and notified in writing to Tile boutique within 7 calendar days after delivery of the Shipment, failing which no action for damages may be brought against the carrier or Tile Boutique. Receipt of the Shipment by the Recipient without written notice of damage on the delivery receipt is prima facie evidence that the Shipment was delivered in good condition. As a condition for the carrier considering any claim for damage the Recipient must make the contents, original shipping cartons and packaging available for inspection by the carrier and Tile Boutique. Tile Boutique and the carrier reserve the right to inspect damaged Shipments on the customer’s premises as well as the right to retrieve the damaged Package for inspection at the carriers or Tile Boutique facility. All of the original shipping cartons, packing and contents must be made available for inspection by the carrier and Tile Boutique and retained until the claim is concluded.

  1. Financial Information - Any personal financial information for processing orders such as bank or card details that you provide to Tile Boutique, Tile Boutique Product Agencies will not be stored. The data / information that has been taken down will be shredded and destroyed.
